Quiznos Franchisee Association Will Appeal

Franchisee Association vows to fight against Quiznos franchisor "in state court, federal court or the moon..."

DENVER (Blue MauMau) - The Toasted Subs Franchisee Association (TSFA), an independent association representing Quiznos franchisees, announced today its disappointment at yesterday's dismissal of franchisee allegations by U.S. federal Judge William Griesbach.

The twelve Wisconsin-based Quiznos franchisees plan to pursue consumer fraud and violations of the Wisconsin Fair Dealership Law in state court. It will also attempt to overturn the District Court's decision in the federal appellate court.

One criticism of the franchisee lawsuits presented by Klein to other states has been that the filings were essentially carbon-copies of one another. As such, the other states would take the lead from Wisconsin's dismissal that the allegations lack legal merit.

Mr. Klein disagrees.

"This ruling has no effect on the other class action cases pending against Quiznos, which are alive and well," says Mr. Klein. "The franchisees will continue to pursue their Federal claims and consumer protection claims in the existing class action lawsuits and wherever else necessary to ensure that the Quiznos franchisees are given a fair opportunity to receive a return on their investment and the wrongs of the past are rectified. As for the Wisconsin Quiznos franchisees, they will also continue to vigorously pursue relief within the bounds of Judge Greisbach’s opinion, and plan on appealing the decision with respect to those areas we feel the Court got it wrong. "

In a strongly worded memo issued to the press, Toasted Subs vowed, "Those Quiznos franchisees that have been wronged by the company are entitled to justice. The TSFA will work with its franchisee members to pursue it in state court, federal court or the moon, if they must. But the TSFA will not rest until justice is done and will not stop because of this obstacle. This fight is far from over. In fact, it has only just begun. The TSFA is prepared to go the distance, using whatever legal means are available, to bring about change in the Quiznos system so that the thousands of struggling franchisees can finally make a reasonable profit."
