IRS Demands Near-$1 Million Payment from Francorp's Boroian
CHICAGO - Donald Boroian, self-proclaimed to be one of the world’s most sought-after consultants in creating franchising chains, is once again being sought after by the Internal Revenue Service. On May 13, a Notice of Federal Tax Lien was issued in the amount of $939,623 for 1040 and 6672 payroll taxes for year 2006 and 2009. The notice demands payment stating,
“. . .we are giving a notice that taxes (including interest and penalties) have been assessed against the following-named taxpayer. We have made a demand for payment of this liability, but it remains unpaid. Therefore, there is a lien in favor of the United States on all property and rights to property belonging to this taxpayer for the amount of these taxes, and additional penalties, interest, and costs that may accrue.”
Boroian, founder and principal of Francorp International, has been at the center of controversy over the years. With a career spanning more than four decades, Boroian touts that his company has provided consulting services to more than 10,000 companies as well as creating full franchise development programs for more than 2,000. But recently his career seems to be running amuck. On July 27, 2006, Boroian surrendered to the Duluth Federal Prison Camp to serve out his sentence of one year, one day for tax evasion for failing to report $388,752 in income from his company in 1998, and for failing to report $108,850 in taxes. While in prison, he was placed in solitary confinement for conducting business from his cell, which is a federal offense.
But after being released on July 21, 2008, Boroian once again took over the reins of his company. Since that time, rumors have surfaced indicating he has struggled with keeping employees, meeting payroll, paying taxes and previous tax liens. He has also embattled in a lawsuit brought by franchisees of one of his clients, South Beach Franchising, which is expected to go to trial sometime this year.
