Bakers Delight Censorship Attempt Denied

MELBOURNE, Australia (Blue MauMau) - In an attempt to gain control of the Bakersdelightlies.com website, Bakers Delight laid a complaint on January 2, 2008 with the World Intellectual Property Organisation (WIPO), seeking an order that the domain name be transferred to Bakers Delight control.

The WIPO has investigated the Bakers Delight complaint and returned its decision in favour of the respondent.

In summary the WIPO found that “the website does not have any commercial content, and is apparently dedicated to genuine criticism, with relevant non‑commercial links. There is nothing before the Panel to establish that the Respondent is making any commercial gain, from visitors or advertising or otherwise, and is apparently not attempting to divert users looking for the Complainant’s site. “

Accordingly, the Panel found that “the Respondent has on the face of it a legitimate interest in respect of the disputed domain name.”

Note: Bakers Delight is the world’s largest bakery franchise, operating in Australia and New Zealand as Bakers Delight and trading under the name of COBS Bread in Canada and the United States.

This is an important decision.

Congratulations to all of those involved in Australia. Your tenacity was a win for those wishing to communicate about franchising in a non-commercial but "libel chill-free" way.

The problem is that there needs to be dozens more wiki-Blue MauMau communities specializing in following areas:

  1. financial institutions (loan programs),
  2. sales agents,
  3. franchisors & associations,
  4. regulators,
  5. media,
  6. franchise bar,
  7. research, archiving, and
  8. topics du jour (race, fraud-proofing, tomfoolery, etc.)

HOW GREAT! FREEDOM OF SPEECH IS PROTECTED.

We will be watching Australia to see whether or not the government will recognize the unfair and predatory practices that franchisors engage in.

Only when franchisors have to disclose the success or failure of the First Owners of their franchisors will their be fairness in frasnchising and competition to caputure the cheap labor and capital of franchisees who wear the brand name.

As long as franchisors can sell new franchises out the front door and capture the assets of their first-owner failures to their own advantage, the franchisee sacrifices will continue.
