Dismissed without Prejudice
a dismissal that does not bar the plaintiff from refiling the lawsuit.
In federal court, this is governed by FRCP Rule 41 .
The Supreme Court, citing to Black's Law Dictionary, uses the definition "[a] dismissal that does not bar the plaintiff from refiling the lawsuit within the applicable limitations period."
Filing in the wrong court will not toll the statute of limitations. Nor will it grant personal jurisdiction in the proper court. So it is possible that you can have your case dismissed without prejudice, but still be unable to file a new suit.
