James Amos To Become Tasti D-Lite CEO

James Amos, the past chair of the International Franchise Association, CEO of Sona Medspa and former top executive of Mail Boxes Etc., will become chief executive of a frozen-dessert chain, Tasti D-Lite.  Amos partnered with private equity firm SPG Partners to acquire Tasti D-Lite, a chain of some 34 stores that sells frozen dairy desserts located from New York to Florida. Recent article in Tennessee paper says Jim Amos is still head of Sona MedSpa, also on the board of Meineke Car Care Centers (one would think Meineke would want a better image!).

I came upon this site while researching the Tasti D-Lite franchise opportunity. Would the previous posters elaborate on why this might not be a good idea? This recently-laid off, would-be franchise owner with very limited funds appreciates any all comments and insights! Thanks.

I once asked the same questions as you did about Amos.

You can find the thread here on Jim Amos' problems as CEO of Sona Medspa. Amos and others were cited by a Texas 4th Court judge for a conspiracy against franchisees, but Amos settled out of court before trial. He was given a stern warning by the judge in his minutes. Here's a snippet from the minutes in which we no longer have the link.

"The jury found, inter alia, that Scott, Amos, and Holt were involved in a conspiracy. Amos and Holt had settled before trial, and, after the verdict, Scott settled by way of a non-dischargeable agreed judgment in his bankruptcy case for $1,500,000."

The state of Texas 4th Court changed their website so the old link posted here no longer works. Anyone have the new link so that readers can review the whole document?

LET THE BUYER BEWARE.
I believe their were some comments about Jim Amos in the UPS Store, Tales of Gore, Blue Mau Mau, or maybe the AAFD site that you could read. I think someone said they wouldn't buy an ice cream bar or a candy bar from him.
From my viewpoint, if Tasti D-Lite doesn't provide sales or earnings figures and has a record of many transfers within the network, I would look elsewhere.
I imagine Mr. Amos would have the same kind of UFOC that he worked up for the other franchise opportunities he has been associated with and this is a "killer contract" unless you succeed, and success sometimes means working long hours at low pay.
Knowing that you are feeling desperate and want to replace the income from your job, please consult with an attorney or an advisor for help in your decision if you haven't the ability to read and understand the terms of the UFOC.
You must understand that in this contract that you will sign, they will have premeditated acquiring the assets of the busines in the event of failure and that the "liquidated damages", i.e. "royalties damages" may hold you prisoner at bteak-even or below, or you will lose all that you have invested
I know you are not even thinking about the possibility of failure but KNOW that your franchisor IS. Understand that the names of the franchisees with whom you can check don't really mean this much and that this is just a substitute for coming up with hard facts about sales and earnings, etc.. Ask yourself why this person would be talking to you about their private business and why, under the law, their names and personal telephone numbers are printed in the UFOC.
Did they agree to this? Why? if they had a bad experience?
Read about "churning" and franchise failure, and hope that some actual TastiLite Franchisors will come on to Blue Mau Mau and tell the truth about their experiences.

Jim Amos is out for himself. He wraps himself in God and Country and then soaks you for all you are worth. Former Mail Boxes Etc. franchise owner. I was lucky I got out in time!

If you see the Jim Amos, former MBE CEO or his daughter Heather's name- RUN AWAY AS FAST AS YOU CAN.  Jim's slimey dealings include several felony indictments, but all were "settled".  From a franchisee point of view- any franchisor who hires Jim Amos has not done their " due dilligence" and should be held accountable for hiring a known( historically) BAD GUY!

False Accusations

"Bad guy" and "felony indictments" ring as false accusations to most of us unless it is backed by credible links and sources. Please source the "several felony indictments" that were settled out of court.

There are lots of "dogs" out there so be careful. An acquaintance of mine in Chicsgo just told me that he and a lot of others had lost lots of money on a Ladies' Workout Express, I think.

Do you research and remember that the "concept" is important as well. Like ---is Tasti D-Lite really a good concept ------there are so mazny ice cream franchises and some of them are having trouble.

Try to find a concept that is hot now. Maybe, Dale, who posts on this site or Frankman would tell you what they think is "hot" in concepts and give you a price range.

FIRST & FOREMOST, let me Welcome the ‘Tasti D-Lite’ prospective franchisee to Bluemaumau.  We’re equally glad you’ve found Bluemaumau, and hope you’ll register and become a regular!

SECOND, let me say Thank You to the guest who suggested that I might provide some insight into “What’s Hot and What’s Not”!

Okay, with the courtesies out the way, let me say “I do not normally toss out a list of What’s Hot in franchising”, for two reasons.

  1. What might be GREAT for one person, could easily be a NIGHTMARE for another.  Selecting the right franchise starts by looking inward not outward.
  2. In the past I’ve made off-the-cuff remarks about ‘HOT CONCEPTS’ only to have someone go out and buy a franchise, like it was some type of insider trader secret or something.  Fortunately it worked out for them!

On the flip-side, I seldom jump to publicly bad mouth a franchise concept without having ‘real evidence’ that it is a flawed concept, or that management simply is inept.  I will often provide confidential counsel as to the risk associated with a concept relative to another.  With that said, I’ll remind you that “Past Performance is the Best Indicator of Future PerformanceBUT IT DOESN’T GAURANTEE IT (Good or Bad).

Best advice, Don’t get in a hurry!  Visit several franchise concepts before making a decision!  You can not talk with too many franchisees!  Keep good notes about each concept, and everything you discover about it, I actually recommend having one notebook for each concept.  If you have a spouse, let them participate in every step of the process.  Don’t sign anything that you don’t completely understand!  There are experienced advisors who can help you with the process if you would like to have assistance.

Tasti D-Lite/other Ice Cream Franchises

Not to go off topic, but are some ice cream franchises having troubles? I've found a couple of Ben & Jerry's stores up for sale, and also looked at Coldstone Creamery and Maggie Moo's. Those costs are a bit high though, especially Coldstone. Thanks in advance!

Ice-Cream Futures

I don’t think ice cream or ice cream franchise concepts are in “trouble”.  With that said a few things to keep in mind.

  • Ice Cream concepts have become very popular over the past 20-years or so.  Creating more franchisors and franchisees of Ice Cream concepts.  Thereby creating some markets being over served (pun intended), or the potential to become overly saturated.
  • Ice Cream concepts in many markets have seasonal fluctuations, which will be magnified in an overly served market.
  • Low-carb life-styles and increased awareness of childhood obesity have also had their impact on the genre.
  • Many QSR segment have begun to include Ice-Cream options as an additional profit center or co-brand opportunity.

When evaluating an Ice-Cream concept, site selection, market and competitive analysis all become critical to your evaluation process.

A more general comment to your post, when looking at ‘Business for Sale Registries’ containing 1000’s of businesses with 100’s in any particular market segment, it’s easy to have false concerns raised by the familiarity of a brand.  An overly simplified example, if you list all Widget Concepts for sale, there may be 100’s listed but when sorted alphabetically, those who share the same brand become grouped together and when combined with familiarity make one think “Oh No, what’s going on with this concept”.
