New Aus Laws Limp In
The Australian Competition and Consumer Commission has pronounced new legislation as a job well done.
The laws strengthen protection against unfair terms in standard form contracts; and changes to the Franchise Code mean franchisees will have more relevant information to assist prospective franchisees make more informed decisions before entering an agreement. ACCC
At the last minute Government was lobbied to drop franchising from inclusion in changes to unfair contract term legislation.
These new laws are designed to protect consumers where they cannot effectively bargain and are offered contracts on a take it or leave it basis.
Changes to the Franchise Code have been denounced as minor supercilious tweaking that will not effectively address any problem presented to 3 franchising inquiries where virtually all recommendations from Inquiry Committees were totally ignored.
The proposed South Australian [Franchise] Law delivers strong deterrents against rogue practices where the Code does not. SA Law offers access to affordable dispute resolution where the Code does not.
