To know if a franchisor has registered their trademarks with the U.S. Patent and Trademark Office, click the link below. The simplest way to search is to click "New User Form Search (Basic)" and then the name of the franchisor.

Mr. Franchise On iSold It's Business Week Quotes
Submitted by Patricia on Wed, 2007/09/05 - 08:33.Some really interesting comments by Mr. Franchise on the statements made by Sully in the August 31st Business week article "Can You Profit As A Franchise Pioneer." Per Mr. Franchise, it makes no sense for Sully to say they added risk factor language after the fact so current franchise owners could learn about problems with the business model, when they needed to know this before they bought their franchise in the beginning. And I really liked his comment about Sully's statement that no disclosure was necessary in the UFOC because salespersons allegedly told the franchise buyers about a wild, wild West risk. According to Mr. Franchise, this is an admission by Sully that they didn't follow franchise disclosure laws that require everything be in writing in the UFOC. I didn't see any other franchise attorneys pick up on this. Good ammo for failed/failing iSold It franchise owners.

Tucked into a Middleburg Heights business park amid shipping companies and electrical wholesalers, you’ll find streams of children and parents nearly every day entering Pump It Up, the national children’s birthday party franchise owned by Mr. Scullin and his wife, Aimee. It’s a place where kids can jump in Pump It Up’s indoor inflatable playground, then enjoy pizza and cake with the birthday child.
Northeast Ohio franchisees and entrepreneurs like the Scullins are tapping into a growing demand from parents for fun, safe and unique kids’ birthday party experiences. Driving that demand, say the Scullins and others, are the busy schedules and disposable cash of today’s two-income families, along with a healthy dose of suburban parental competition.
“There’s definitely some keeping-up-with-the-Joneses going on,” laughed Mr. Scullin, who also owns the Pump It Up in Avon.

iSold It Debacle - Mr. Franchise Predicted UFOC Amendment
Submitted by Patricia on Sat, 2007/07/28 - 07:34.It seems the legal team from iSold It read Mr. Franchise's article about the lack of disclosure in their UFOC about their unproven concept, including his observation this would be an issue in future litigation. So, they finally added the new disclosure to their UFOC which should have been there from the very beginning. Of course, this might help iSold It deal with franchises who buy under the new UFOC (and who would be crazy enought to do this). But the sudden appearance of the new disclosure is going to be a big smoking gun that will help past franchisees who sue for inadequate disclosure and misrepresentation. Hope the legal team has a LOT of malpractice insurance.
