THE HISTORY CHANNEL - It was the worst one-day massacre in the United States to that date. On July 18, 1984, 41-year-old James Oliver Huberty walked into a McDonald's restaurant in San Ysidro, a suburb of San Diego, California, and opened fire with an arsenal of guns, killing 21 people and wounding 19. Huberty's murderous rampage ended 257 rounds and 77 minutes later when he was shot dead by a police marksman stationed on the roof next door. The victims ranged in age from eight months to 74 years. Huberty worked as a security guard in San Diego but was fired for failing to perform his job properly. One week later, he called a mental health center asking for an appointment, and a receptionist took his name but did not call him back. The next day--July 18, 1984-- Huberty took an Uzi submachine gun , a shotgun, and a semiautomatic pistol to McDonald's and killed 21 diners. Huberty's wife later filed a $5 million suit against McDonald's, claiming that her husband's rampage was caused by eating too many Chicken McNuggets.

It seems the legal team from iSold It read Mr. Franchise's article about the lack of disclosure in their UFOC about their unproven concept, including his observation this would be an issue in future litigation. So, they finally added the new disclosure to their UFOC which should have been there from the very beginning. Of course, this might help iSold It deal with franchises who buy under the new UFOC (and who would be crazy enought to do this). But the sudden appearance of the new disclosure is going to be a big smoking gun that will help past franchisees who sue for inadequate disclosure and misrepresentation. Hope the legal team has a LOT of malpractice insurance.

Some really interesting comments by Mr. Franchise on the statements made by Sully in the August 31st Business week article "Can You Profit As A Franchise Pioneer." Per Mr. Franchise, it makes no sense for Sully to say they added risk factor language after the fact so current franchise owners could learn about problems with the business model, when they needed to know this before they bought their franchise in the beginning. And I really liked his comment about Sully's statement that no disclosure was necessary in the UFOC because salespersons allegedly told the franchise buyers about a wild, wild West risk. According to Mr. Franchise, this is an admission by Sully that they didn't follow franchise disclosure laws that require everything be in writing in the UFOC. I didn't see any other franchise attorneys pick up on this. Good ammo for failed/failing iSold It franchise owners.
