Winsport Master Franchise Claims The Athletes Foot Not in Compliance With Agreement

Despite The Athlete's Foot being Atlanta-based, the signed Franchise Agreement is in Italian, not English. The clauses in Italian is where CEO Giuseppi Musso of Winsport S.A. says that the terms of the franchise agreement were not met by The Athlete's Foot or its subsidiary Athlete's Foot Marketing Europe, located in France. We make no claims to the accuracy of the English translation, which is done by the Italian Master Franchise.

Art. D pag 18. “L'affiliante (TAF) costituirà un comitato di selezione al quale parteciperanno rappresentanti dell'affiliante, dell'affiliato principale e degli affiliati principali degli altri territori. Tale comitato di selezione avrà per obiettivo quello di selezionare, per i negozi della rete di franchising The Athlete's Foot i prodotti piu' idonei alla stagione interessata, oltre a organizzare gli acquisti all'ingrosso."

Musso: The Franchisor must create a Committee together with the Franchisee (Winsport) that will select the products for every season for The Athlete's Foot Stores in Italy. The Committee will organize the wholesale purchasing of the products mentioned (by the way wholesale purchasing never made by TAF).

E pag. 19. “L'affiliante (TAF)si obbliga a fornire all'affiliato principale (Winsport) un elenco di fornitori “selezionati” per la qualita' dei prodotti offerti e del prezzo praticato che permettono all'affiliante(TAF) di mantenere alta' l'immagine della rete e di fornire degli articoli della qualità richiesta. Inoltre l'affiliante per tali prodotti si impegna a garantire tramite accordi con detti fornitori migliori condizioni d'acquisto rispetto a quelle concesse ai singoli dettaglianti non appartenenti alla rete.”

Musso: The Franchisor TAF bind itself in providing to the Franchisee (Winsport) a list of “selected” suppliers. Selected means both in terms of product's quality but more important in terms of purchasing price of the products. In fact the Franchisor bind itself in guanteeing through special agreements with the suppliers, better purchasing conditions than the normal not-affiliated retailers.

E 2 pag 19. “L'affiliante e l'affiliato principale selezioneranno tra i prodotti di questi fornitori “selezionati” gli articoli suscettibili di costituire il “campionario” dei negozi The Athlete's Foot per il mercato italiano; tali articoli costituiranno dunque la collezione dei negozi The Athelete's Foot in Italia.”

Musso: The Franchisor (TAF) and Franchisee (Winsport) will select together the articles from selected suppliers. Products that will enter in the Italian market and those products will be The Athlete's Foot collection in Italy.
