Wendy's Brought Suit against Former Owner DavCo in 2014

DavCo Restaurants, former owner of the Wendy's restaurants that NPC International just acquired, was Wendy's fourth-largest franchisee and had been a franchisee since 1976. When it refused accede to Wendy's demands that it remodel its restaurants and install a new, universal point-of-sale system, Wendy's brought suit on December 31, 2014 for breach of contract. DavCo responded that Wendy's wanted to grab its restaurants on the cheap. This sale to NPC International brings the suit to a close. DavCo, which owned 152 Wendy's restaurants when the suit was initiated, is no longer a Wendy's franchise owner.

According to new owner NPC's website, it was the eighth largest restaurant unit operator in the U.S. before this latest 140-unit Wendy's acquisition.
